Pat Smith is the "lucky" model. 3 Men Beaten At Jail Reveals Negro Officer A five-year veteran of the Atlanta police Department revealed Thursday that he witnessed fellow police officers brutally beating three Negro men at City jail last Saturday night. The Negro officer. Dewitt Smith said five white police officers, including a lieutenant sadistically beat Guy Phillips. 29 Herbert Williams, 23 and Billy R. Lewis, 19, after they were brought to the police station following their arrest about 10:30 p.m. Saturday on Auburn Ave. Officer Smith made his revelation during a press conference. He said "I was helpless" in the situation" I could not sleep that night after I got off duty. It was brutal and uncalled for. Smith said that two of the three arrested men Phillips and Lewis, were dragged into a waiting room at the police station where they were beaten, choked kicked and stomped Both men punched in the face and body, sustained injuries which required medical attention at Grady Hospital immediately after the vicious assault. Phillips was charged with intering with a police officer; Lewis was arrested in a charge of profanityy; and Williams was charged with drunkenness. Officer Smith also told how a police sergeant walked into the room while the men were being beaten and was ordered to "stay out of this." You are off duty, go home .. this isn't any pf your business, the sergeant was told, related Smith. Phillips said an officer hit him in the jaw and threatened him by saying "I ought to kill you nigger." He said while he was being herd face down, by an officer he was kicked in the "ribs. He said he asked the officer not to kick him because he had just undergone surgery. Officer Smith said he submitted a report of the incident to Supt. Jim Brown. Smith said he was intimidated for making the report, and requesting that it be brought before the Aldermanic police committee. Police Chief Herbert Jenkins issued a statement after Smith's press conference. Jenkins said that he had a copy of the report and an investigation is being made. He said appropriate action will be taken when all facts are determined. The accused police lieutenant said: there has not been any mistreatment of prisoners at any time in the city jail. officer Smith said he was hurt to see the brutal attack upon the arrested men and it should not be allowed to happen again. 2 Atlantans In Hospital Harold Thomas, retired postal clerk and J. The two men who have been hospitalized at Hughes Spelding through the week are reported in satisfactory condition latest reports stated. McNair has appointed Mrs. Daisy Dunn Johnson, career counseling and placement director at South Carolina State College, a member of the newly created State Board of Juvenile Corrections. Prison Guard Sentenced For Relation With Inmate A former Atlanta prison farm guard pleaded guilty in DeKalb County Superior Court to charges that he committed sex relations with a woman inmate, court records revealed. The guard, Robert C. Rhodes, 23, entered the guilty plea after the charges were changed from rape to fornication. He was charged with two counts of fornication. Judge Richard Thibadeau sentenced Rhodes to one year probation on each count and imposed a $2,000 fine. Rhodes admitted having relations with the woman, who was described, as a mental patient, but maintained she consented to the act. The incident took place, June 15 at the prison farm, located in DeKalb County. The woman, who has arecord of being a patient at Central State Hospital was con fined to isolation at the time. Rhodes reportedly had checked the male isolation section and borrowed keys from the matron to the women's ward and did not return the keys for almost an hour. The incident did not come to night until the next day when a supervisor reported it: to Capt. R. F. Jordan, superintendent at the prison. Upon questioning the inmate, she gave statements that Rhodes assaulted her and was taken to Grady Hemorial Hospital for examination. Jordan said Rhodes had been employed at the prison farm for only a month and he had planned to terminate Rhodes when a replacement could be located. Jackson Georgia The Airline Family attended the funeral of Willie Arline, father of Grover Arline in Jacksonville, Florida on Monday. Sgt. Charlie Lee Wise died suddenly in Port Bragg, N. C. on Sept. 6. His funeral was held on Thursday at the Mt. Zion Baptist Church with Rev. W. L. Reynolds officiating. Sgt. wise is survived by his mother, Mrs. Lizie K. Wise, grandparents, Mr. and Mrs. Alonza Appling, two brothers, two sisters, four aunts, two uncles and a host of other relatives. Pvt. Attorney Appeal Case On Suspected Obscene Material United States Attorney John W. stokes Jr. said Wednesday an appeal may be made to the Supreme Court of a three-judge federal panel ruling unconstitutional a law that allowed the Post Office to hold up deliveries of suspected obscene material. But Stokes said he would have have to study the decision before deciding what kind of recommendation to make to the Justice Department regarding the case. The ruling by the three-Judge federal court announced Tuesday resulted from a case brought by the government against the Book Bin here. The decision deemed unconstitutional sections of the law that allows a postmaster to order mail addressed to suspected vendors returned to the senders and which allaw courts to order such mail detained by the Post Office pending a hearing. The judges said this, in effect permitted a lengthy administrative process to determine the issue of obscenity. The Post Office was trying to stop the store from distributing copies of "Models de France," a magazine-type publication growing pictures of nude women models in full color. Exhibits by the Post Office also showed The Book Bin was advertising pendulum books such as "Raped in the Grass," and "Nazi Field Whores." The three judges, U. S. Circuit Court of Appeals Judge Lewis R. Morgan and U. S. District Judge Frank Hooper and. Newell Edenfield agreed that section of the law under which the Post Office acted in detaining the alleged, obscene material did not meet the test of constitutionality. The opinion said "we understand the concern of Congress and the Post Office to restrict the flow of obscenity through the mails. "It may perhaps be true that criminal punishment, for mailing obscenity under the law is an inadequate weapon in the Postmaster General's arsenal. "However, it is vital that prompt judicial review on the issue of obscentity — rather than merely probable cause — be assured on the government's initiative before the severe restrictions" of detaining the malls are imposed. The judges said the statute provides "a chilling inhibition of First Amendment rights" by permitting a lengthy administrative process to determine obscenity. More Arrested In Threats Against Life Of Mayor Evers Two more white men, one with a submachine gun in his possession, were arrested Wednesday following assassination threats against Negro Mayor Charles Evers. The latest came after Dale Walton, 48, former head of a littleknown Ku Klux Klan group, was picked up in Fayette. Tuesday night in a gun-laden car near a shopping center owned by Evers. Walton was charged with speeding and carrying concealed weapons. City attorney Martha wood, one of the few whites serving in Evers' administration in this small southwest Mississippi town said it was not known whether there was an assassination plot against the veteran civil rights leader. "It is still under investigation," she said, but added: "It could have very well been a plot." Evers, former state, field director bf the National Association for the Advancement of Colored Peoplle, said he received three anonymous telephone calls Tuesday warping he had been marled for death. Federal officers said two other white men had been in the car with Walton prior to his arrest. The two taken into custody Wed nesday were Bobby Haywood and Pat Massengale. Haywood. 18, lives at Walton's residence in Tupelo, Miss. He was apprehended at a Natchez motel. Officers said they found a submachine gun in his possession. Massengale, 50, a former Hattiesburg tavern operator was picked up at his home in Hattiesburg by agents of the federal alcohol, tobacco and firearms division.
