Russell, D-Ga. chairman of the Senate Armed Services Committee, declared May 20 he favored using nucrear pons of any size necessary against Communist China to avoid an outright U.S. defeat in Viet Nam. Russell, 67, recently recovered from e long illness, also announced he would be a candidate for his seventh term, in the Senate but said he would not campaign for 14 months. Russell said if Red China eventually poured masses of troops into the Viet Nam trouble zone the United States would have no choice but to use nuclear force. The United States cannot efford to pull out of Viet Nam since it is committed to defend the Asian nation against Communist aggression, he said. A pull-out would serve notice this country will not stand un against communism, he told a news conference. Artists Rights Group Makes Initial Grants The Artists Civil Rights Assistance Fond, a nonprofit organization composed of painters writers, photographers and others in the arts, has announced its first grants, totaling $8,500. Organized a few months ago, the Fund lists Harry Belafonte, Hugh Downs, Theodore Bikel, Bobby Darin, Chad Mitchell, and the Peter, Paul and Mary folk trio among its membership. Members have pledged to contribute one day's earnings to the Fund's treasury to be used for such projects as medical facilities and services, legal representation, and voter registration drives. The grants, announced May 18, consisted of one for $2,500 to the Albany (Ga.) Nursery School, and another for $6,000 to Attys. Charles Conley, William Kunstler and Arthur Kinoy. Mrs. Warren Williams, executive director of the Artists Fund, said the attorneys are currently engaged in the legal representation of the 300 or more persons indicated in Alabama because of their civil rights activities. Some 200 of those indicated were arrested for participating; in peaceful demonstrations during the recent SelmaMontgomery march. Alaskan Helps NAACP Southern Voter Project Among the over 200 applicants for the NAAOP summer protect in Alabama. Mississippi and South Carolina is a former member of the House of Representaties in Alaska. Mrs. Blanche Louise McSmith, president of the Anchorage, Alaska, NAACP Branch has lived in Alaska for the past 15 years. During that period she has been active in both NAACP and other community activities. She served in the Alaska Legislature in 1859-60. A former president of the Business and Professional Club and the Anchorage Tuberculosis Association, she has also held offices in the Anchorage League of Women Voters, Anchorage Mental Health Association and the Anchorage Toastmistress Club. Mrs. McSmith is a graduate of the University of Southern California and holds a Master's Degree in Social Work. She has taught with the U. S. Air Force and worked for the U. S. Navy. AP Staff Writer Found Dead With Throat Cut Associated Press, staff writer James Charles Waldrup was found dead in his apartment Monday with his throat cut. Police said it was murder. The body was found lying face up in the bedroom dorway. Police said Waldrup, about 26 also had received a severe blow on the head from the unknown assailent. Police said the apartment appeared to have been ranshacked. Waldrup's wallet and expensive foreign car were missing. The time ofdeath was estimated at late Saturday or early Sunday. Waldrup, a member of the Associated Press bureau here for more than a year, was a graduate of the University of Missouri Journalism School at Columbia, Mo. He was also a graduate of Ensley High School in Birmingham where he played football. He served in the Navy four years and was discharged as a Lieutenant J. G. Waldrup worked in public relations in Birmingham before joining the AP. He was found in his apartment by police after a missing persons report was filed, according to Stan Atkins, AP bureau correspondent here. Waldrup's apartment was on the second floor of an old Mobile home about a mile from downtown. Waldrup was last seen at work in the bureau in the Mobile Press Register building Saturday night. Study Shows Only Negroes Die For Rape In Florida A study of convictions and executions of whiles and Negroes for the crime of rope in Florida concludes that Negroes have been "hand-picked" for the death penalty. The study was sponsored by the Florida Civil Liberties, union, and conducted by 11 law students from the University of Florida at Gainesville and the University of Miami. Florida is one of 17 Southern and border states where rape is punishable by death. In all 17 States, the report, charges, "The death penalty for rape is a tool of the racists and bigots — and its purpose is to impose punishment upon Negroes where the methods of the lynch mob and the Ku Klux Klan have failed or fallen into dis repute." Statistics for the 17 States are cited from reports of the U. S. Bureau of Prisons showing that hetween 1930 and 1963, 402 Negroes, as opposed to 45 whites, were exeed for rape. In Florida, during the period Jan. 1, 1940 to Dec. 31, 1964, the death penalty was imposed on 48 Negroes and 6 whites. The high ratio of Negro to white executions for rape, the report points out did not go unnoticed in the post. On throe occasions, lawyers, Asking the Florida Supreme Cour to commute the death sentences of Negroes convicted of rape charged this high ratio indicated discrimination against the Negro, and the denial of due process and equal protection of the laws. The court found, however, that the meer fact of more Negro execu tions than whites was inconclusive evidence of discrimination and that more complete statistics were needed — such as the total number of whites and Negroes tried and convicted of rape. The Florida CLU study was underteken to supply the missing data. Court criminal records in Florida county seats were searched, as well as records of the Division of Corrections, the Pardon Board. and sheriff's office throughout the State. After months of work a complete record of rape conviction: in Florida between 1940 and 1964 was compiled, giving the races of defendants and vietims. It was learned that in the 25-year period there were 285 conviotions for rape — 132 of white men. 195 of Negroes. Of the rape convictions 24 were for rope of white women 63 of Negro women. The report declares that no white man in Florida has been sentenced to death for the rape of b Negro female and that no Negro has lied for the ape of another Negro — adult or child. But of the 84 Negroes convicted of rape of white women, 45 were sentenced to death, and 29 having already been executed. The report concludes that only Negroes die for the crime of rape in Florida (with the exception of white homosexuals), and that the death penalty is deliberately utilized to punish inter - racial sexual attacks by Negroes," This practice, the report says, is discrimination" by the State and therefore is prohibited by the 14th Amendment. The report also comments unFavorably on the Pardon Board which is empowered to commut death sentences, and which. claims, is guide 1 by no recognizable criteria established by low; and upon the fact that the rape of children, even by Negroes, is less harshey regarded by the courts and the Pardon Board that the rape of adults: Do's And Don'ts NAACP Executive Director Roy Wilkins paid tribute this week to the Catholic press, its lay and clerical editors, for their important contributions to the civil rights campaign. Speaking at the World Congress of the Catholic Press at the Waldorf-Astoria Hotel here on May 19, Mr. Wilkns noted that the CathoLic sokesmen have "recognized from the beginning that this is a moral question. They have emphasized again and again that man's human rights are God-given." Praising the Catholic Church's stand against bigotry, Mr. Wilkins stressed that "Catholics have been active for many, many years, often without fanfare. "The fair employment bills enacted by so many state legislatures since the first one in in New York in 1945 have had the active support of Catholic clergy and laymen," he said. Mr. Wilkins further stated that "credit for the extraordinary drive which has marked the civil rights movement in the past two years must go to the three great faiths: Jewish, Protestant and Catholic. "Thousands of ministers, rabbis, priests and nuns have been witnesses, in their home towns and cause," he continued. The NAACP Executive Director also praised a "very practical effort in the Roman Catholic Archdiocese of Detroit (where) the purchasing power of the church (will) be used to persuade businesses to adopt nondiscriminatory hiring practices." The previous evening, Mr. Wilkins spoke at the Catholic Interracial Council Dnnner where Francis Cardinal Spellman received the LaFarge Memorial Award for Interracial Justice. Quarterly NAACP Report Shows Gain In Members Memberships in the National Association for the Advancement of Colored People for the first quarter of 1965 are up 15 per cent over the same period last year, Executive Director Roy Wilkins revealed this week. Citing a report of Miss Lucille Black, the Association's secretary for membership. Mr. Wilkins said that, as a result of this increase, at the end Of April nearly 100,000 members had been enrolled in the current membership drive. Mr. Wilkins attributed: the inCrease to the major membership drives, being conducted in big city NAACP units such as St. Louis, Cleveland, Detroit, Washington, D. C. Los. Angeles. Kansas City, Mo., Kansas City. Kaps. New OrLeans, Houston, Philadelphia, Baltimore, Cincinnati. Pittsburgh, Chicago, Now York City and Brooklyn. The report indicated a rise in the memberships' from smaller NAACP branches also, he added. When the NAACP launched its annual spring membership solicitation campaign on April 1, Mr. Wilkins called on the Association's nearly 2,000 local units to recruit 700,000 members in 1965 in order to regain the loss suffered last year. Asks Half-Million More To Finance Civil Rights Cases The Civil Rights Division of the Justice Department, estimates that it will need $2,452,400 to carry on its work during fiscal year 1966, beginning July 1. John Doar, Assistant Attorney General in charge of the division, told a House subcommittee on appropriations that this amount is $243,800 more than the sum required for the current fiscal year. Details of his testimony before the subcommittee were ... released May 18. He said Congress approved an additional fund of $1,093,000 in the Supplemental Appropriations Act of 1965 for 109 new positions for the division to permit the immediate enforcement" of the 1964 Civil Rights Act. But, despite in extensive recruiting campaign, his office was unable to hire the entire new staff, because of the time consumed in the selection process, Doar said. Some 217 staff positions, including administrative Jobs, are authorized for the Civil Rights Divison, but only 157 are actually filed. Another 28 lawyers are in process of being hired. Doar said the provisions of Title VII of the 1984 Civil Rights Act relating to equal employment opportunity, which become effective July 2, will Increase the division's workload and make necessary the hiring of 40 additional eople. policy of the Justice Department to encourage "voluntary local solutions" to racial problems. To avoid law suits, his attorneys confer first with local officials about the requirements of the law and explore the possibilities of self - correction." During the past year, he declared, negotiation had produced voluntary compliance with Federal law forbidding racial discrimination in registration for voting in parts of Georgia, Mississippi, and South Carolna. "The almost universal adherence to the new requirements," Doar commented, was preceded by "numerous coherences between Justice Department representatives and businessmen throughout the Southern and border States. "Our expertences to date justify completely our reliance in this approach." In a number of cases, Doar added, colored citizens are denied the right to vote in two ways: discrimination by registrars through qualification tests and intimidation by Private individuals or office holders. The Cvil Rights Division's procedure in proving violations in this area involves an analysts of the regstration and voting records of the counties in question and 'numerous detailed interviews' with individuais. The first step in a voting action is to make a request to local officials to insert and photograph registration records. If they balk the division seeks a court order making them available under Title III of the 1980 Civil Rights Act. "Next, the records are carefully analyzed, and if violations, of Federal law have occurred, they are brought to the attention of State and local officials as the basis of voluntary corrective action. Failing this, Doar told the subcommitttee, a suit is filed under the Act. When colored citizens complain that they have been threatened, intimidated or coerced for the purpose of interfering with their right 10 register and vote, a similar investigation is made. Again, if voluntary corrective action is not taken by State officials, a suit is filed. By the end of the past fiscal year, the Civil Rights Division had filed a total of 61 suits under the voting provisions of the Act, compared to 41 at the end of the previous year, and a total of only 12 cases during the period from Sept. 1958 to June 20, 1961. Trials and hearings were in 23 cases during the past, fiscal year.
